Before the first hammer swings, understanding your legal obligations can save you from fines, forced demolitions, and neighbour disputes. Portugal has a clear regulatory framework for building works — and Cascais Municipality is strict about compliance.

When Do You Need a Permit?

Not all renovation work requires a formal building permit (Licença de Obras). Minor interior works — repainting, replacing fixtures, non-structural flooring changes — generally do not. However, works that change the floor plan, move load-bearing walls, alter the building facade, modify the roof, or affect shared drainage systems require a Comunicação Prévia or full Licença de Obras from Cascais Câmara Municipal.

As a rule of thumb: if your contractor will be demolishing or building walls, or if the work is visible from the street, seek professional advice before proceeding.

Condominium Approval

If your apartment is part of a condominium (condomínio), the administrators must approve any works that affect common areas, building systems, or the exterior. This includes: replacement of windows visible from outside, modifications to balconies, any work affecting the building's drainage or electrical risers, and structural works.

Submit a works plan to the condominium administrator in writing. Most condominiums have rules on permitted working hours — typically Monday to Friday, 9am to 6pm — and may require a deposit against any damage to common areas.

In Portugal, building firms must hold a valid Alvará de Construção from IMPIC (Instituto dos Mercados Públicos). Always ask to see this documentation.
